What AI misses in healthcare apps

- PHI in logs: AI-generated error handling routinely dumps full request objects to console or log files. If those requests contain patient names, diagnoses, or treatment records, your log files are now an unencrypted PHI store with no access control.

- Missing Business Associate Agreements: Any vendor that touches PHI needs a signed BAA. AI tools will integrate Supabase, Firebase, or a third-party email service without checking whether that vendor offers a BAA. If they do not, the integration is a violation.
- No audit trail retention: HIPAA requires audit logs retained for six years. AI-generated logging, when it exists at all, has no retention policy. Logs rotate, get overwritten, or live in ephemeral serverless environments that disappear on redeploy.
- Encryption gaps: HIPAA mandates AES-256 encryption at rest and TLS 1.2+ in transit. AI-generated code often uses default database settings, which may or may not meet the standard depending on the provider and plan.
The Sharp HealthCare precedent
In November 2025, a class action was filed against Sharp HealthCare alleging that ambient AI recorded over 100,000 patients without proper consent. False consent statements appeared in medical records.
The lawsuit is not about whether the AI worked. It worked fine. The question is whether the consent framework, the data governance, and the audit trail met HIPAA requirements. They did not.

- Audit logging: Every access to PHI logged with user identity, timestamp, resource accessed, and action taken. Append-only. Six-year retention.
- Vendor compliance: BAAs confirmed for every service that touches PHI before integration begins.
- Consent management: Patient consent captured, stored, and enforced at the data access layer, not just the UI.
The AI then builds features inside those boundaries. It still moves fast. But every feature it ships handles PHI correctly from the first commit.
The cost of retrofitting
